This mobile application "Eiffage App," available at the address https://app.eiffage.com and on the Apple Store and Google Play Store (hereinafter referred to as "Eiffage App"), is published by the company Eiffage.
By accessing and navigating the "Eiffage App," the user agrees to these Terms and Conditions of Use (hereinafter "TCU"). By accessing the "Eiffage App" through any means (such as computer, mobile, tablet, etc.), the user acknowledges having read these terms and agrees to comply with them without reservation.
1. Definitions
The terms defined below will have the following meanings, whether used in the singular or plural:
- "Personal Data": refers to any information relating to an identified or identifiable natural person (hereinafter referred to as the "data subject"), as defined by Article 4 of Regulation (EU) 2016/679 (hereinafter the "GDPR"). An identifiable person is one who can be identified, directly or indirectly, notably by reference to an identifier such as a name, identification number, location data, online identifier, or one or more specific elements of their physical, physiological, genetic, mental, economic, cultural, or social identity. Personal data includes any data that enables the identification of users.
- "User": refers to any person accessing the "Eiffage App" (e.g., visitors), whose Personal Data may be collected. • "Device": refers to the various devices through which the "Eiffage App" may be accessed, including smartphones, tablets, computers via the internet (PC or Apple), and any connected or connectable objects.
2. Purpose
These TCU aim to set the terms and conditions for accessing, providing, and using the "Eiffage App," its features, and content by users.
A user who refuses to comply with these TCU should not access or use the "Eiffage App." These TCU form a legally binding contract that is enforceable against users who access, navigate, and use the "Eiffage App" in any way.
3. Services Provided by the "Eiffage App"
The main purpose of the Eiffage App is to inform the user about the life of the Eiffage group: new contracts, project news, events, organization, etc. It is divided into two parts: a public part (external) and a connected part for Eiffage employees.
- Public part (for external audiences): The Eiffage App provides information about the life of the Eiffage group: new contracts, project news, events, organization, etc.

Connected part (for Eiffage employees): The Eiffage App is also for employees of the group (with SSO access). Its main goal is to inform each employee about Eiffage's life: external news (new contracts, project updates, events, organization…) and internal news (internal events, HR information…) as well as practical services at the Pierre Berger Campus in Vélizy (concierge services, fitness room…). Anyone with an Eiffage email address will access the connected part of the app. The "Eiffage App" also allows all Eiffage employees to post messages (short text posts that can be associated with an image*).
*Images posted must comply with safety rules on construction sites: mandatory PPE and no risky behavior. They must not harm employees or the group. Any non-compliant images may be removed.
- Notifications : By downloading the "Eiffage App" to your smartphone, you can receive notifications. A notification is a message that informs you of the publication of new content on the "Eiffage App" even when it is closed. Upon first use of the app, you will be asked if you wish to receive these notifications. You can also later enable or disable notifications in the "Settings" menu on your smartphone. Employees can choose the types of content they wish to receive notifications for. They can also receive notifications when posts are published by other Eiffage employees.
4. Personal Data
Eiffage collects Personal Data about users as part of the posts published on the "Eiffage App." Regarding the app website (app.eiffage.com), Eiffage collects Personal Data related to users' navigation. Personal Data is collected, processed, recorded, and stored in accordance with applicable legal provisions, including the French Data Protection Act of January 6, 1978, as amended, and the GDPR. Eiffage encourages users to read the Privacy Notice to understand the processing of their Personal Data when accessing and using the "Eiffage App" and to learn about their rights regarding this data processing.
5. Intellectual Property
Eiffage owns, among other things, the domain name https://app.eiffage.com. This mobile application is a work of the mind: the "Eiffage App" and each of its components (animated or not, illustrations, photographs, sounds, know-how, texts, graphic elements, etc.), including the software and databases (hereinafter referred to as "Content"), are protected by intellectual property rights, particularly copyright, design rights, and trademark rights.
Unless stated otherwise, intellectual property rights to the Content are the exclusive property of Eiffage, another company in the group to which Eiffage belongs, a third party, or a partner who has granted usage rights to Eiffage. Eiffage does not grant any license or sublicense for all or part of the Content, nor any right other than the right to use the "Eiffage App" under these TCU.
The user acknowledges these rights and agrees to respect them. Any use, modification, reproduction, extraction, representation, and translation, in whole or in part, of the Content by any means is strictly prohibited without prior written consent from Eiffage or the holder of the protected right.
Likewise, any unauthorized reproduction of literary, musical, audiovisual, photographic works, or any other works that may be protected by intellectual property law, accessible via the "Eiffage App," is prohibited under penalty of civil and/or criminal sanctions, in accordance with Article L 122-4 of the French Intellectual Property Code, unless such reproduction is exclusively for private use. Eiffage, or any other rights holder, may take any action, including legal measures, to stop any infringement of its intellectual property rights and reserves the right to seek damages in case of such an infringement.
6. Hyperlinks
Any creation of links to the "Eiffage App," any framing of the "Eiffage App," or more generally any use of an element of the "Eiffage App" requires prior written authorization from Eiffage and may be revoked at any time at its sole discretion. All websites with hyperlinks to the "Eiffage App" are not under the control of Eiffage. Therefore, Eiffage disclaims any responsibility (including editorial responsibility) for these sites.
7. Cookies
Regarding the app website (app.eiffage.com), Eiffage collects Personal Data related to users' navigation. To obtain information about cookies collected during navigation, users are encouraged to consult the Privacy Notice and the "Cookie Banner" document.
8. Modification
The use of the "Eiffage App" is subject to the TCU in effect at the time of use. Eiffage reserves the right to modify and update these TCU without prior notice. To be informed of any changes, users are advised to review the TCU regularly.
9. User Behavior
Users agree to comply with these TCU. In particular, users agree not to:
- Use a false identity to deceive others or provide Eiffage with false, stolen, or incorrect information.
- Harm others through the "Eiffage App."
- Create a hyperlink to the "Eiffage App" without prior written authorization from Eiffage. • Damage Eiffage's reputation or that of other users through the "Eiffage App."
- Post defamatory, obscene, offensive, violent, or inciteful content, or content that is political, racist, or xenophobic, or any content contrary to laws, regulations, or good morals.
- Attempt to probe or test the vulnerability of the "Eiffage App" or violate security and authentication measures without authorization.
- Disrupt or interfere with the "Eiffage App" or its connected servers or networks, or violate network regulations connected to the "Eiffage App."
- Try to damage or damage the use of the services provided by the "Eiffage App."
- Disclose unnecessary, sensitive, or third-party confidential information.
- Engage in personal data processing obtained through the "Eiffage App" in ways that could harm the privacy or reputation of others.
Users must respect intellectual property rules related to the content of the "Eiffage App," whether it concerns Eiffage's rights or those of third parties.
10. Posts and Publication Rules for Employees
The app allows all Eiffage employees to post messages (short text posts that may be associated with an image).
As with any open forum, it is important to follow rules of courtesy and professionalism:
- Use polite and appropriate language.
- Avoid off-topic or private discussions.
- Respect everyone's privacy (no personal or family information or photos).
- Follow the professional rules of the group (confidentiality, ethics, safety standards, etc.).
- Comply with the law (no illegal content, such as unauthorized image distribution, harassment, fraud, defamation, racial discrimination, incitement to violence or hatred, or political, sexual, racist, or xenophobic speech). Eiffage reserves the right to delete any post that violates these publication rules.
At any time, for any reason, Eiffage may terminate or suspend the user's access to the "Eiffage App" without notice if the user violates these TCU.
11. Liability Disclaimer
The user uses the "Eiffage App" at their own risk, acknowledging that they are solely responsible for their use. Eiffage takes all reasonable measures to provide quality, regularly updated information on the app. However, Eiffage cannot guarantee the accuracy or completeness of all information. Additionally, the "Eiffage App" may change or evolve without prior notice. Eiffage disclaims any liability for the content of third-party sites linked to the "Eiffage App."
12. Access to the "Eiffage App"
In case of force majeure, technical difficulties, or maintenance reasons, access to all or part of the "Eiffage App" may be suspended or terminated by Eiffage.
13. Entirety
If any clause of these TCU is invalid due to changes in legislation, regulation, or court decisions, it will not affect the validity of the remaining clauses.
14. Applicable Law and Competent Courts
These TCU are governed by French law.
ANY DISPUTE RELATING TO THE EXISTENCE, INTERPRETATION, PERFORMANCE, OR TERMINATION OF THESE TCU BETWEEN THE COMPANY AND THE USER WILL BE SUBJECT TO THE EXCLUSIVE JURISDICTION OF FRENCH COURTS, EVEN IN CASE OF MULTIPLE DEFENDANTS.
